Whether or not the house will be involved in your spouse’s bankruptcy depends on whether or not their is any equity in the home. Equity simply means “will there be any money left over after paying off the mortgage, real estate agent, lawyers etc if you sell your home”. If there will be mopney left over then an amount equal to your spouse’s share of the equity must be paid into her bankruptcy – or her trustee may seize and sell the house.
This sounds complicated, but whatever trustee your spouse is speaking to will be able to tell you very quickly if the house is at risk.
