Please help with Canadian law on seisure of home
My husband and i have been separated for 3 months, in our negotiations i received the home we lived in together, i have now found out he is filing for bankruptcy, business and personal. His name is no longer on title nor is he responsible for the mortgage payments. My question is this, can they still take my home from me or force the sale of my home, since i did not pay him for his portion of the equity in the home, instead i gave up alimony and child support payments, since he didn`t have the money to pay me anyway and never see`s his child. Your help would greatly be appreciated. Thankyou so much.

If it’s a real separation and you had a lawyer sign-off on the agreement then you shouldn’t have any problems. It won’t surprise you to hear than people have tried to “fake” their separations before to defeat bankruptcy law and it usually ends in a disasterour way…
If you want a higher level of assurance that you will be okay speak to a lawyer about it if the trustee handling your ex’s bankruptcy calls you.
