This will be up to the lender. Technically speaking if your payments are in default or if you file a bankruptcy the lender can seize the vehicle. This doesn’t mean they will, but it means they have the legal authority to do so. Now the majority of lenders do not seize vehicles regularly as long as you are up to date on your payments, but you are best to contact a local trustee to verify what the local practices of the lender you are dealing with and taht way you will have a better idea of what to expect.
