I want to take my name off the morgage as my partner is very nervous to lose the house which is mostly his…can i do this and then claim bancrupcy?

I would recommend against this. Firstly, the bank is not likely to remove your name unless your partner is able to qualify for the mortgage all on their own, and even then it is questionable. From the banks standpoint that puts them in a more risky position than they would be in with two people listed and they tend to like the added security.

The second reason is that as soon as things are changed prior to filing bankruptcy, even if it is innocent, it appears that you may be involved in something that is done to thwart the rights of creditors (i.e. arranging finances in a manner that is detrimental to the people you owe money to). Even if your intentions are harmless it may result in increased scrutiny of this and other transactions and you are best to simply not go down that road as it will result in a significantly smoother bankruptcy process.
