Home in ex husbands name and mine

My ex husband and I have been apart for just over 2 1/2 years. I have been in the house raising our 2 children whom live with me full time. The plan was to buy him out once I could and I have been the one paying EVERYTHING as though it is in my name only – he pays no bills what so ever. I am wanting to either look into debt settlement or b.r. for the bills I have since we have split up. How will this effect the house in both our names and I am able to remain in the house & pay him at some point as arranged and able or do I have to sell the home. I am in no trouble with my mortgage company regarding payments at all.

Largely this will depend on how much equity is in the house. You are best to contact a local trustee, bring in all the details surrounding your situation (i.e. value of house, amount of mortgage, a normal monthly budget, and a list of your creditors) and the trustee will be able to help you determine if there is any risk to your house, if there is what the risks would be and how they would be best handled.
