Has the bill enabling student loans to be applied to bankruptcy been passed yet, I was under the understanding that it would be passed this fall. Please respond.

Yes, on July 7, 2008 the rules for student loans changed so that if you have been out of school for 7 years as of the date you file for bankruptcy then your student loans will be cleared.
If that 7 years has elapsed I would recommend you contact a local trustee to determine if bankruptcy will indeed work given your situation.
