Hi there.
I have a couple of student loans that were accumulated over several years. I went to school for one full year and finished in 2002, which would mean it would be almost eligible for bankruptcy. I returned to school in 2005 but was there only two months as I was not given the funding to complete the programs. The issue that I am having is not that interest relief has ended, but that there has been a stop put on my eligibility due to a loan that was apparently taken out by me, but have no record of. Is it possible, in any way, due to the short length of time in 2005 that I attended classes, to apply for bankruptcy? There is no way I am able to afford to pay the amounts they are asking and I have no desire to have collection agencies calling and harassing me due to the fact that they will no longer give me interest relief even though I am still eligible. Please, please, please….can you offer any sort of solution or alternative?!

The new laws contain a hardship provision that allow a person to apply to the Court after they have been out of school for 5 years. If you were last in school in 2005 (even if it was only for a couple of months), you will be eligible to apply to the Court in 2010 for releif under the hardship rules.
