Bankruptcy before the new regulation
Hello,
I got my degree Dec 2001 and May 2002 I have filled for bankruptcy. I was discharged 9 months later, but at the time, my student loan was not covered by this.
In 2006, a collection agency was charged to collect the money I owe.
Is it possible under the new legislation to include the student loan in my 2002 bankruptcy? What should I do, because I`ve worked hard to rebuild my credit, but the student loan is still a major issue in my credit file.

You have the right to apply to the Court in order to have your student loans from 2001 included in the bankruoptcy that was discharged in 2002. Contact the trustee that handled your file to see if they are willing to assist you, alternatively you may hire a lawyer to make the motion on your behalf.
The Court will consider your income since 2002, whether or not you have made any payments towards the student loans since that time and whether or not the Court thinks you have received an economic benefit from your education (ie are you working in the filed that you trained in).
