Five year student loan period

How does the court decide whether or not to include student loans in a discharge that will fall under the 7 year limit, but greater than 5 from the end of study date?

As the change in legislation is so new it is impossible to predict how strict the court may or may not be, but essentially you have to have acted in good faith, show that your education really provided very marginal benefit (i.e. not used to get your current job) and demonstrate “hardship” meaning that you really have no hope of being able to pay this amount back in the future.
