Returning to school

I am currently deciding to declare bankruptcy on a 13 yr. old student loan…I have a chance to return to school funded by Service Canada…the course I took 13 yrs ago was not completed…am I still able to declare bankruptcy on the student loan and return to school by being funded by Service Canada…

There are two things you need to check:

1) You’ll have to ask Service Canada if by filing bankruptcy you are still eligible for their subsidy – I can’t think of any reason why you wouldn’t be, but I think you should ask them directly yourself (to be sure).

2) If the new course(s) you are going to take are a continuation of your old program of study then sumply by registering you may be re-setting the 10 year clock on your student loans (ie they may no longer be dischargeable by bankruptcy). I think to be safe, you should wait until after you have completed your bankruptcy and the debts have been discharged before you register for more classes.
