This question has a lot of different aspects that may come into play on whether taking possession of this vehicle would be proper or not. If your family member is going through a bankruptcy or consumer proposal process, it would be best to speak to a trustee with some more information about the debt and the vehicle in question. If there is no bankruptcy or proposal ongoing, a lawyer would be a better person to speak to about a matter like this.
