If I File Bankruptcy Do I Still get to Keep My Child Support Payments?

Bankruptcy & Child Support Payments.  I receive Child Support for one child.  Would that be exempt from seizure by creditors if I default on credit cards? Thank you.

A court would not grant an order for child support to be garnished. However, if you file for bankruptcy child support is included along with wages etc. in determining whether or not you have “surplus income”. Under the guidelines set out by the Superintendent of Bankruptcy, you are required to pay 50% of the surplus to the Trustee. The current guideline amount for a family of two is $2,508 per month
