Certainly – you and your spouse each have the right to do whatever you think best to deal with your financial problems. If your situation warrants an assignment in bankruptcy then you may do so and your wife will be excluded (unless she decides to file herself or jointly with you).

A word of caution – if you file your spouse will be held responsible for any joint debts so make sure you carefully review all of your debts BEFORE you file to make certain you know which your spouse will have to repay.
