Unemployed

I am considering applying for bankruptcy. I am currently unemployed and looking for work. In the meantime my spouse and I are living off of his income. Am I able to apply for bankruptcy while unemployed or do I need to have a job first? If I apply while unemployed will I be expected to aquire employment in order to finish the term of bankruptcy? I understand that my husbands income will count as part of our household income.

There is no requirement to be employed in order to file for bankruptcy. Most trustees suggest because they know people that are out of work have better things to spend their money on than legal fees – eating and the rent come to mind.

So you certainly can file while unemployed, just be prepared for whatever trustee you speak with to suggest that you wait until you find work before you do.
