Support Arrears
March 5th, 2013 by Questions
My ex and I are about to sign a separation agreement where it states he has to pay me an arrears payment. If he files for bankruptcy prior to signing it does it affect me? or if he signs it after he files does it affect me?

Spousal and child support payments are one of the types of debt which survive a bankruptcy in Canada and thus must continue to be paid. Any arrears of up to one year before the date of filing or lump sum amounts are considered preferred and thus receive priority payments ahead of other creditors.
