Ex-husband claimed bankruptcy

June 20th, 2012 by Questions

My ex husband claimed bankruptcy. Matrimonial home was still in both names. Do I not have to legally be served bankruptcy documents by my ex-husband because of this?

Only creditors would be provided any documentation in relation to your ex husbands bankruptcy and those would not be served but would be sent by ordinary mail or electronic transmission. However, I would expect the trustee to be in contact with you as there may be some equity in the premises that would have to be realized on for the benefit of your ex-husband’s unsecured creditors.
