I would like to repatriate to Canada after living in California for 28 years. Can I declare Bankruptcy, on American debt, if I live in Canada?

Yes and no. Your Canadian income and assets will be protected and your US debt will not be able to pursue you in Canada if you file for bankruptcy here, BUT any future income or assets in the US will NOT be protected. In addition, you must include any Canadian debt(s) if you file here.

If US debt is the problem then you’d be better off filing in the US and then moving back to Canada.
