My spouse refuses to submit paystubs
I am thinking of going bankrupt. I have aproximately 38000 of unsecured debt, wich includes credit cards and a student loan from 2001. It is my understanding that I have to include my spouses income in order to calculate the total household income. He doesn’t wany any part of this. And we do not own or have consigned together for anything. I have a daughter from a previous relationship and we have a son together. Can I still go bankrupt if he doesn’t comply? if so how. Please advise.

There is a way to deal with just this situation. Where you file for bankruptcy and your spouse refuses to divulge their income what happens is that the way your surplus income calculation is done is adjusted. It is a bit of a complicated adjustment to run through in this type of forum, but if you contact a local trustee they will be able to walk you through how this calculation changes.
