I HAVE TO SEE A LAWYER NEXT WEEK ABOUT FILING BANKRUPTCY

I HAVE TO SEE A LAWYER NEXT WEEK ABOUT FILING BANKRUPTCY. I AM ON 2 VERY SMALL PENSIONS, OMERS AND CPP. CAN MY CREDITORS FREEZE OR TAKE MY PENSIONS. I HAD TO QUIT WORKING AT 56 DUE TO MULTIPLE HEALTH ISSUES AND TAKE REDUCED PENSIONS. THIS IS ALL I HAVE TO LIVE ON AND HAVE NO OTHER FAMILY FOR HELPING ME,

First, lawyers cannot file bankrutpcy for you. You need to speak with a trustee – we are the only people licenced to filed bankruptcies and consumer proposals in Canada. If the lawyer isn’t going to charge you for their time then it is ok to go and see them, but if they are charging your for their time I suggest you cancel the appointment and call a trustee (who will speak to you for free).

The next thing you need to know is that pension income may not be seized or garnisheed by your creditors. Before you decide to file for bankruptcy (or commit to any other solution) ask whomever you see to explain how pensions are protected under the law. You may decide not to do anything at all after they explain it to you.
