CPP & OAS

January 26th, 2012 by Questions

I will have to go bankrupt soon and will also turn 65 around the same time. I would like to delay taking my CPP so I will get a higher monthly benefit when I am older. Can my trustee force me to apply for CPP?

Can the trustee force me to apply for Old Age Security?

A trustee cannot force you to apply for CPP or OAS, but if you are leigible (and don’t apply) they have the right to assess you surplus income based on the income you are eligible to receive. This rule is designed to make certain people don’t deliberately keep their income low to reduce the amount they might have to pay into a bankruptcy.
