Filing Bankruptcy

September 22nd, 2010 by Questions

My former husband`s business went bankrupt in the early 80`s. Because my name was on the business as well we both had to file bankruptcy, both business and personal. After the discharge I checked my credit record and the bankruptcy was never noted on my file.
Due to unfortunate circumstances, I find it necessary to consider personal bankruptcy. If and when I see a trustee, should I disclose the first bankruptcy even though it was never on my credit record?
Thank you for answering my question.

Yes, you should. Your trustee is going to do a serch for prior insolvencies before they let you file anyway – it is always better for you to disclose the prior event, rather than have them find it for themselves and start wondering what else you haven’t told them…
