i`m newly married and my husband has old debts that we can`t seem to get under hand if he applies do i have to too because we are married?

If all the debts are in your husbands name and you are not attached to them in (i.e. you never signed on them) the you legally are not responsible for them, regardless of your marital status. As a result there would be no need for you to file into bankruptcy it would only need to be filed in his name.
