Rent and Damage to rental unit
June 24th, 2010 by Questions
Hi, I put a stop payment on my last month of rent and I plan to file for bankruptcy shortly. I have now moved out, and the landlord is going after me for unpaid rent and damages to the unit. She has my deposit, but wants more. Can the landlord still get a judgement against me and make me pay, or does it get dismissed during bankruptcy? Can you help me I am in Vancouver BC.

If the loandlord can demonstarte that you damaged the unit and if they obtain a Restitution Order (as opposed to a Civil Judgment) then this debt wiull survive a bankruptcy.
So, if you did damage the unit you can save yourself some legal fees by agreeing to pay for the damages. If the landlord takes you to Court the legal costs will be added to your bill…
