Single or Joint Bankruptcy in a Marriage
Is there such a thing as single bankruptcy in a marriage. One spouse files but the other does not? Or both are affected anyway because we are married. If single is possible, how does this work?
Thank you

I often will have one spouse file bankruptcy without impacting the other. The key is how your debts have been signed. If you are the only party who has signed on the debt then there is no need for the both of you to file a bankruptcy. To determine if a single bankruptcy will be sufficient you should meet with a local trustee, they will look at who you owe money to and help to determine if there would be any impact on your spouse or if a joint filing would be necessary.
