Returned car loan
I declared bankruptcy, my spouse and I had two cars, and returned the one in which I was the primary holder. He was placed on the form for his income. When we returned the car, we were up to date on the payments, and filled for bankruptcy for me afterwards. Will they come after him for the payments? all this would accomplish is the fact that they would force him into bankruptcy if they do. I filed for bankruptcy a month ago, and have recieved a letter from the finance company that i missed a payment on the car loan. I do not have the vehicle and returned it to the dealer.

If your spouse co-signed (co-borrowed) for the car you returned then the finance company will be within their rights to try and collect any outstanding payments from your spouse. This is something that should have been discussed with your trustee before you filed – I suggest you give them a call and discuss it now.
