I have a good job. my husband is unemployed and owes back taxes. we own a house together. Can he declare bankruptcy on his own

Yes he may file by himself – you will only be involved in so far as you have joint assets (the house), joint debts (probably the mortgage, but you may have others) and his payment will be based on the house hold income (that means you’ll have to disclose your pay every month).

When your husband goes to see a trustee I suggest you tag along. Not only is it supportive of what he may have to do, but it allows you the chance to ask your own questioins to the trustee BEFORE your spouse decides to file for bankruptcy.
