Do I need to go through a trustee to declare bankruptcy??

Yes you do. When you file for bankruptcy a trustee is assigned to your estate. You cannot serve as your own trustee, nor can anyone who is not licenced by the federal government as a trustee do so.
This leads to a very important point. In the last few years there has been a dramatic increase in the number of people calling themselves debt consultants and credit counselors. Some are legitimate not-for-profits sanctioned by the province in which they ioperate. Most of the debt consultants are simply going to charge you a fee and then refer you to a trustee.
Before you agree to any fees or payment plan with a credit counselor or a debt consultant ask them straight out if they are going to refer you to a trustee. If they are then why would you pay them the fee – you can call and speak to a trustee for free.
