Surplus

Hello, I get paid a bse salary plus commission. Now if I go over the surplus for 4 months and fall below for the following 5 months and at the end my 9 months I average less then the surplus will they consider me over because of those 4 months. I am of course talking about bankruptcy under the new rules.

At this point everything will hinge on your average surplus. If you average surplus is greater than $100 (so surplus being your income less the amount allowed on the guideline), then you will be obligated to stay in bankruptcy and make payments for a total of 21 months.
