New bankruptcy laws in Canada

My husband and I claimed bankruptcy in February 2009 and we are of the understanding that as first time bankrupts we will be automatically discharged in November 2009. We have been paying surplus payments monthly. Will we now be required to pay for 21 months as opposed to 9 months.

I think it is unlikely – the new rules will apply to persons that file on or after Sep 18, 2009. That being said, if for some reason your file goes to Court, the Court may decide to impose the same discharge period as the new laws provide for – all this means is make certain you do everything that you are supposed to do so you’re less likely to have to go to Court…
