legal fees

My bank has now sent out a demand letter for the back payments with the mortgage. They also indicated there would be legal fees involved. I am willing to let them foreclose yet don`t want to file bankruptcy as I would pay too much in surplus income. Am I able to include these legal fees and CHMC shortfall, if any, (as I have approx 30,000 equity) in a proposal with my other unsecured debts.

Yes, these legal fees (along with the remainder of the shortfall) could be included in the filing of a consumer proposal. This is a standard item in many proposals I have seen and you shouldn’t have any issue with this.
