John

My wife and I separated over a year ago. Since then I have moved out of the province. Gave her everything. I paid off all bills incurred during the marriage, except the mortgage which she took over. She is now claiming bankruptcy… over a year and half later. Am I still responsible and will have the bankruptcy status even though I didn`t claim such. She was responsible to pay the mortgage, I paid off bills that she had. Is there anything I can do to clear myself from this.

If you are still listed on the mortgage this could still impact you. Now it isn’t the bankruptcy that will directly impact you, it is the mortgage. If the mortgage is foreclosed on and she files bankruptcy then she is absolved of any responsibility of the debt. As you are still listed on the mortgage you will then be fully responsible if there is any shortfall (i.e. if the sale price is less than the total balance of the mortgage).
