What happens if my husband and I declare bankrupcy, we paid the trustee all the fees at the beginning. However, what happens if we do not keep up with the payments of the monthly fees to the trustee

If you don’t meet all of your obligations to your trustee (and that includdes making whatever payments that are required) then you will not be discharged from bankruptcy. At some point, your trustee will close the file and then you are back where you started – except you can’t simply file bankruptcy again. You’ll have to either repay the debt or complete the first bankruptcy.

I should warn you, if your trustee closes their file and you want it re-opened later there will likely be a substantial penalty (cost) to do so.

Go and speak to your trustee and try and work something out. Once you start a bankruptcy it is in your best interest to finish it…
