Mental illness and declaring bankruptcy

My spouse was recently diagnosed with a mental illness . He had been running up massive debt (over 100,000 dollars) for the past year which he had been hiding from me. He was arrested last month after bizarre behaviour in his workplace and committed for observation to a psychiatric facility where he still is forcibly confined. We have a joint account , we own our house jointly. He may have assets and liabilities which I don`t know about. How do I proceed with the debt now? Can I declare bankruptcy on his behalf?

If you have Power of Attorney over your spouse’s affairs then you may file for bankruptcy on their behalf – otherwise, you don’t have the leagl right to do so.

I suspect you should be speaking to a Family Law expert (lawyer) to determine what you need to do to help your spouse and protect your self.
