`household Dwelling`

May 1st, 2009 by Questions

I was curious about what they consider persons living in the same household, what if it`s one house but 2 seperate apartments with my mother in law and husband owning the home and myself only filing for bankrupcy but we live in one aparmtment and my mother in law is in the other which is above us, we do split on utilites, mort. payments etc. but my name is not on the property and i am the only one filing do they just consider myself and my husband the # of persons in the household because it`s just the 2 of us in one apartment as our own dwelling or are they going to take everyone who lives in the home under consideration for surplus? hope I have made sense.

thank you.

This is something you are best to discuss directly with a local trustee. While based on the above information I would think the household unit would really only focus on those living in your apartment, but it is always difficult without looking at things in more detail.
