What if some household items didn`t belong too me when I moved in to my current spouses home, my name is not on the property at all and I didn`t move in with much do they consider all furnishings etc. to be mine because we are married as well or just what is mine, my spouse is concerned they will want to know his belongings too and that will get added to the mix

I suspect you are worrying about something that isn’t really a problem. Under Ontario law, you are entitled to retain ownership of $11,300 worth of furnishings if you file for bankrutpcy (your spouse is also entiteld to a further $11,300). I’ve only ever met one person who furnishings exceeded that value – if you think yours do then there is cause for concern, but if they don’t then you have nothing to worry about.

Raise this issue with whichever trustee you go and see – I am confident they will give you the same answer that I have given you.
