Bankruptcy in Assignment

Hi,
I started a bankruptcy in Alberta in 2004, for various reasons it never got completed. Currently it`s on Assignment with the Trustee who is requesting $2000 to reopen the file, then pay the standard fees. Some minor debts have occured since then, what are my options here? How do I clean this up?

An assignment in bankruptcy is what you originally filed with the trustee back in 2004. What I think you mean is that you are in bankruptcy and your trustee has been discharged. If that is the case you need to go back to your original trustee to finish your file. It is going to cost, and the $2000 doesn’t sound unusual. You will also have some other duties you will have to fulfill as part of this, which really will include all of your original duties that you neglected to comply with and may include additional payments, counseling sessions, income statements, providing copies of tax returns and the court may also put some additional penalty in place for your failure to comply with the bankruptcy in a timely fashion. So don’t expect this to be the only thing you will have to do as part of this process.

Additionally this will only deal with the bankruptcy and the debts listed on the bankruptcy. Until you deal with that you really don’t have any options other than paying your existing debts as they become due. You have to finish the first bankruptcy before you will have any options.
