Discharge
We have filed Bankruptcy in July/04. My husband is on Workers Comp and I have a minimum paying job. We did not get a conditional discharge that is after 9 months. We managed to pay the Trustee the entire amount in October/07 and still she hasn’t given us the discharge. I received my credit bureau from Equifax showing that I stilled owed one of the Creditor. So may I know who is at fault as whenever I call the Trustee we are given the run around.

If you are not discharged automatically at the end of the first 9 months your trustee no longer has the ability to grant your discharge – instead, a hearing must be scheduled and only the Court may grant your discharge.
If you live anywhere in the Toronto Court’s area (which covers a very large piece of Ontario) you may be simply waiting for a hearing. Currently, if a hearing is requested immediately after the 9 months ends you wait from 3 to 6 months. In your case, since you didn’t perform your duties until the 3rd year, I suspect the Court feels no urgency in your matter. It may sound callous, but it took you 3 years to do what you should have done in the first 9 months, the Court may simply be taking their time…
In case there is a problem with your trustee, I suugest you call an ask them one more time for the status of your discharge. If you don’t accept their answer try calling the Court yourself or the Superintendent of Bankruptcy and ask them.
