surplus incom

My husband and I together have filed few months ago for the bankruptcy. We are coming to the end of January. It looks like he has around $700 in surplus I don`t have any, my qustion is since we filed jointly would they spred the 700 on both our names or just on his? Because it looks to me that because of that extra income they will extend our bankruptcy for onother 3 months. Thank you. Your web page is great.

It’s not well known, but just because your bankruptcies were filed together it doesn’t mean you have to receive the same type of discharge. You may still be eligible for an Auomatic Discharge at the end of 9 months, while your husband may be subject to a Deemed Opposition which will get him a Conditions Met Discharge when he’s paid what he owes.

Gve your trustee a call and see if they are familiar with these rules – if they are not, ask them to call the Office of the Superintendent to confirm what I have said.
