Questions judge may ask

If you have to be present in court for your discharge hearing and you listed gambling as one of your reasons for bankruptcy, should you be prepared to answer questions put forth to you by the judge?

If so what kinds of questions relating to gambling will the judge ask?

You should be prepared to answer the following questions:

1) what form of gambling were you involved with/in?

2) when was the last time you gambled?

3) have you attended and continue to attend counseling for your gambling?

4) if appropriate, have you applied for a self-exclusion from OLGs casinos and other gambling sites?

5) how much of your debt was used to finance your gambling activities?

The are the basic questions you will be asked to answer – depending on your answers the Court may look for additional information…

You should expect the Court to Order you to repay a portion of your debts – maybe 10%, maybe more, again depending on your answers to the questions above.

You should discuss all of this in detail with your trustee BEFORE the hearing. Your trustee should be able to give you an accurate estimate of what is likely to happen in Court.
