filing and marriage
hi there…i would like to ask another question that is related to the one about filing after marriage. if engaged and NOT living together, would it be best to file BEFORE marriage or after? i don`t think it would be fair for my new husbands income to be taken into consideration on MY old debt, especially since we have both made it clear to each other that this is MY debt to repay and not his. i`m not considering LYING for the purpose of filing for bankruptcy (this is an illegal little thing called FRAUD and charged at the federal level in some cases) i just want to know how to best cover myself in the event my circumstances change between now, the time i get married and the time of my filing (i am not eligible to file for four years for student loans).

The key thing is that filing before or after won’t make that significant of difference. Either way when your household income increases you are legally required to disclose it. Now this may result in surplus, it may not, it really depends on the numbers.
If you wanted to minimize the amount of time his income was used it would be better to file sooner than later, but either way, when the household income changes you need to inform your trustee.
