We jsut had a baby and my partner does not know that I have a 25000.00 consumer debt that was consolidated. I was fine, but now on maternity and no job after the maternity ends I am stuck at making the payments. Can creditors go after assets not in my name? What about joint bank accounts? Will my partenr find out that I have gone bankrupt?

I’m not going lecture you on relationships and secrets, but you may want to reconsider your approach to this problem.

To answer your questions: no, your creditors cannot go after assets that don’t belong to you. They might access a joint bank account you have a debt with that bank so you may want to change banks or drop your name form accounts you don’t want to be tampered with.

If you decide to file for bankruptcy you’re not required to disclose this infomration to anyone other than the people you owe money to – if you don’t owe your spouse any money then they don’t need to be told.

That being said, bankruptcy runs for at least 9 months – it is quite possible during that time your spouse will notice a letter or answer a call that exposes what you’ve done – again, you may want to reconsider your approach to thsi problem.
