`Delayed` Bankruptcy

I have been an undischarged bankrupt for more than 7 years now – I was out of the country for some of that time and my divorce caused numerous problems. I have now returned to Canada and wish to complete my bankruptcy. Two questions actually… I would like to finish it myself (I don`t even know who my original trustee was – it was a particularly bad time in my life…) so how do I proceed? Also, I heard that there was a time limit on this anyway – am I still in bankruptcy or do I need to start again? There is also the question of whether I owe anything anymore as well – if a creditor doesn`t collect and has no contact with the debtor then the debt becomes void after a certain time, right? A complicated case….

Firstly, you will still be in bankruptcy, but likely your trustee has been discharged. Meaning you currently sit in limbo, still in bankruptcy, but without any court protection so your creditors legally can come after you for payment in full of all the debt.

In terms of limitation, when your in bankruptcy all limitation laws are suspended, so you are right you need to deal with this.
