if i were to file for bankruptcy; would my common law husband (who is a sole propietor of a small business) have to file also? Are we 2 seperate entities?

If you decide to file a bankruptcy there is nothing that forces your common law husband to file. However, in some instances where there is a great deal of joint debt it is more cost effective for two people to file together (although it is not necessary). Best thing to do is to simply contact a local trustee and they will be able to determine if that would be wise or not.
