My Spouce is deceased

My common law spouce passed away in an automoble accident, just before he was to be discharged. The Trustee went to court and the Judge granted the discharge. Now the Trustee want my death benefit package. But my name was not on the bankruptcy. Can they take it. `we have two small children, and I have no money.

This sounds like a very complicated matter, and one that will really depend on how the death benefit package was set up. In this situation I really wouln’t be in a good position to answer this question as I have know way to review the associated documents. The best thing for you to do is to contact a local insolvency attorney (not a trustee) and have them give you a legal opinion.
