my husband was in bankruptcy for a second time in the year 2000 he did not recieve a discharge. Why, does`nt he get automatic discharge 24- 36 months, under the new law in 2005?

He isn’t entitled to an automatic discharge because when he filed the law was not on the books – in fact, even though it has passed Parliament, it has not been brought into force so it still doesn’t apply today.
Your spouse needs to contact the trustee that he was dealing with and find out what he needs to do in order to be discharged – even if the automatic discharge law had been in place it would not have applied to your spouse as he has failed to do something that was required – until he completes all of his duties he is not eligible for a discharge.
