Can I keep yhis money?

My spose in in bankruptcy, he is only aloud to bring home $3,300 per month until his bankruptcy is finished. I am recieving $5000 for back pay from family allowance. Can we keep it? The check is in my name. I am not in backruptcy.

If the check is in your name and you are not in bankruptcy then you will get to keep most of the check. However, you must report this $5000 as money coming into the household unit and it may indirectly impact your husbands bankruptcy through the Superintendent Surplus Calculation.
