What about my wife?
January 26th, 2008 by Questions
I owned a business and it failed after accumulating lots of debt to suppliers and CRA ($75,000 in unpaid GST and Source Deductions). I have maxed all credit cards and lines of credit and am considering Bankruptcy. How does this affect my wife who doesn`t want to claim bankruptcy personally. All the main credit cards and lines of credit list me as the primary card holder with her just having an extra card.
Does she have to claim bankruptcy as well??

If she hasn’t signed on any loan agreements she is likely not responsible and has no need to file bankruptcy. However if she has signed legally she would be responsible for any shortfall and would have to look at filing a bankrutpcy or a proposal.
