house in wifes name
November 17th, 2007 by Questions
I am probably going to file for bankruptcy soon. My common-law wife (of 5 years), and I have a home together which was purchased 6 months ago. The house is 100% in her name, my name is nowhere on the mortgage or any of the monthly bills. If I go bankrupt can anyone `claim` it is a jointly shared home through a common-law relationship and go after the house and the contents or is that protected as it is 100% in her name?

This will largely depend on the province you live, whether any of your money is used in purchasing the house or for up keep and maintenance of the house. As a result you are best to discuss this in detail with a local trustee .
