Going Bankrupt while temorarily overseas

August 24th, 2007 by Questions

I am currently overseas caring for a dying parent and am not earning much money. I am being persued by a couple of creditors and am now unable to fund an old court case from a previously bankrupt company. I do not want to have a bad record and am unable to fund a trial. Can I file for bankruptcy while caring for my Dad overseas?

As long you owe more than $1000, are unable to pay your debts as they generally become due, the total resale value of all your property is insufficient to pay all your debts in full and you either own property in Canada or have resided in Canada within the last 12 montsh then you are eligible to file a bankruptcy.

At this point the best course of action is contact a licensed trustee in the area you normally reside and see if they would be willing to help make arrangements for you to do things at a distance.
