10 years from last course or graduation
Hello
My question is regarding banckrupcy and student loans.
I have been told that for a student loan to be cleared by banckrupcy a person has to wait a period of 10 years.
My question is:
If a person graduates in 1996, but has taken a single course (say a programming course outside of his or her original program of study for which the loan was issued) in 1998, when does the 10 year ends?
It is not clear if the 10 years is from graduation date or the last course ever (as the example)

The legislation stipulates that student loan debt cannot be released unless 10 years have ellapsed since the last time you attended school (either full or part time), irrespective of when the loan relates.
As a result if you last attended in 1998 the loan technically won’t be cleared until 2008.
However, in practice sometimes we find that student loan departments will consider only the years the loans pertained to. So you can file sooner and hope the cards fall in your favor, but my recommendation would be to wait until 2008.
